The legal agreement between you and aiAxonIQ. Please read these terms carefully before using our platform.

By accessing or using aiAxonIQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Service.
aiAxonIQ is a cloud-based observability platform that enables you to collect, store, query, and visualize telemetry data including logs, metrics, and traces from your applications and infrastructure.
The Service is provided on a subscription basis with Free, Growth, and Enterprise tiers. Features and limits vary by plan as described on our Pricing page.
You must register for an account to use the Service. You agree to:
‣Provide accurate, current, and complete information during registration
‣Maintain the security of your password and account credentials
‣Promptly update your account information if it changes
‣Accept responsibility for all activities that occur under your account
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
Ownership. You retain all rights to your telemetry data (logs, metrics, traces) and any other data you submit to the Service ("Your Data"). We do not claim ownership of Your Data.
License. You grant us a limited license to store, process, and display Your Data solely to provide the Service to you.
Portability. You may retrieve Your Data at any time through the Service's query APIs. Because ingestion uses open standards (OTLP, Prometheus remote-write), your instrumentation remains portable to other systems. Self-hosted deployments retain all telemetry within your own infrastructure.
Deletion. Upon account termination, Your Data will be permanently deleted within 30 days.
Isolation. Your Data is logically isolated from other customers. We do not access, use, or share Your Data except as necessary to provide the Service or as required by law.
You agree not to:
‣Use the Service for any unlawful purpose or in violation of any applicable laws
‣Attempt to gain unauthorized access to the Service or other accounts
‣Reverse engineer, decompile, or disassemble any part of the Service
‣Transmit malware, viruses, or other harmful code through the Service
‣Resell or redistribute the Service without our written consent
‣Use the Service to store or process data subject to ITAR, EAR, or similar export controls without an Enterprise agreement
‣Exceed the rate limits or resource allocations of your plan in a manner that degrades the Service for other users
Free Plan. The Free plan is provided at no charge with the limits described on the Pricing page. We reserve the right to modify Free plan limits with 30 days notice.
Paid Plans. Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law.
Upgrades and Downgrades. You may upgrade your plan at any time; the new plan takes effect immediately. Downgrades take effect at the end of the current billing cycle.
Overages. We will notify you before you exceed your plan limits. We do not charge overage fees without prior warning. If limits are exceeded, we may throttle ingestion or begin dropping the oldest data.
Taxes. All fees are exclusive of taxes. You are responsible for applicable sales, use, VAT, or other taxes.
We strive to keep the Service continuously available, but except as expressly agreed otherwise in writing, the Service is provided on an "as available" basis.
Service availability commitments, and any associated service credits, apply only to Enterprise plans and are defined in the applicable order form.
Scheduled maintenance windows are announced in advance whenever practical.
The Service, including its source code, design, documentation, and branding, is owned by aiAxonIQ, Inc. and protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription term.
Open-source components used in the Service are governed by their respective licenses.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIAXONIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise).
You may terminate your account at any time through the dashboard settings.
We may suspend or terminate your account if you violate these Terms, with notice except in cases of egregious violations (e.g., illegal activity, security threats).
Upon termination, your right to use the Service ceases immediately. Your Data will be deleted within 30 days per our data retention policy.
We may modify these Terms at any time. Material changes will be communicated via email and/or a prominent notice on the Service at least 30 days before they take effect.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms shall be resolved in the federal or state courts located in San Francisco County, California.
